This is the Declaration of Covenants, Conditions and Restrictions for The Villages at Laveen Ranch, a single-family home community in Maricopa Colony, AZ. It establishes a homeowners association (HOA) and sets rules that all owners, residents, and guests must follow. The HOA has the power to enforce these rules, levy assessments, and maintain common areas.
- Architectural review: All exterior changes — including buildings, fences, landscaping, paint, and other alterations — require prior written approval from the Architectural Committee. The committee has up to 45 days to respond. Declarant and Designated Builders are exempt during development.
- Pets: Only a reasonable number of common household pets are allowed, kept as domestic pets only. They must be fenced or leashed, and noise or nuisance is prohibited. Owners must clean up droppings. No structures for pets may be visible from neighboring property unless approved.
- Parking & vehicles: No trucks (over 3/4-ton payload), RVs, boats, trailers, or campers may be parked visibly from neighboring property or streets, except SUVs, certain pickups, and mini-motorhomes used for regular transportation. Inoperable vehicles must not be visible. Parking is allowed only in garages or designated areas. Motorcycles, ATVs, etc., must be parked in garages.
- Leasing & rentals: All leases must be in writing and explicitly subject to the governing documents. Owners must notify the HOA of any lease. Owners remain liable for all rule violations by their tenants and guests. Leases are automatically subordinate to the governing documents regardless of any failure to comply.
- Residential use & home businesses: Lots and homes may be used only for single-family residential purposes. Limited home businesses are allowed if they are not detectable from outside, use no more than 20% of the home's floor area, have no more than one non-resident employee, and meet other conditions. Bed-and-breakfasts and temporary lodging are prohibited.
- Assessments: The HOA levies annual assessments to cover common expenses. Special and limited assessments may also be imposed. Nonpayment creates a lien on the lot and can result in suspension of common area use and other remedies. Transfer fees may apply upon sale.
- Maintenance responsibilities: Owners must maintain their lot's landscaping, driveways, and paved areas, including certain public right-of-way strips. The HOA maintains common areas, perimeter walls (structural repairs shared with owners), and certain party walls. Owners are responsible for painting the side of walls facing their lot.
