What Marabella's governing documents say
This is a supplementary governing document for the Marabella subdivision (Parcels 1, 2 & 3) in Maricopa, AZ, that only addresses membership in the Central Arizona Groundwater Replenishment District (CAWCD). It does not contain typical home or neighborhood rules (e.g., pets, leasing, maintenance). Instead, it imposes mandatory water-related fees and assessments on each lot to secure a certified water supply.
- Replenishment Assessment: Each parcel must pay an annual Replenishment Assessment to CAWCD, based on the parcel's share of excess groundwater use. The amount is set by CAWCD and, if unpaid, becomes a lien on the property and a personal obligation of the owner at the time it was due.
- Activation Fee: A one-time Activation Fee, equal to the CAWCD board's per-unit fee multiplied by the total housing units on the owner's portion of the property, must be paid before a public report authorizing sale or lease of subdivided lands is issued.
- Replenishment Reserve Fee: A one-time Replenishment Reserve Fee, equal to twice the Replenishment Reserve Charge times the projected annual excess groundwater demand for Marabella, Parcels 1-3, must be paid before the public report. Instead of cash, the owner may assign long-term storage credits to CAWCD with their approval. This section does not apply to Category 2 member land.
- Lien and Personal Obligation: All fees and assessments under this declaration constitute a continuing lien on the parcel. Additionally, any person who was an owner when a Replenishment Assessment became due is personally obligated to pay it, plus interest, costs, and penalties.
- Amendments and Binding Effect: This declaration can only be amended or revoked by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area, or by changes to state law. It runs with the land and binds all current and future owners.
- What this document doesn't cover: This document does not address any typical community association rules such as architectural standards, pet limits, leasing restrictions, parking, common area maintenance, or homeowner assessments for amenities.
