This is a 2005 amendment to the condominium declaration for 27° of Paradise Condominiums in Mesa, Arizona. It establishes detailed requirements for how the Association must hire, manage, and oversee a professional property manager. Since this is an amendment to an existing declaration, it does not contain the full rulebook for the community.
- Property manager hiring & contract terms: The Association must hire a single licensed professional property manager. Contracts cannot exceed 36 months and may be terminated with 30 days' written notice; if terminated for cause, no cancellation fee is owed.
- Property manager qualifications: The manager must be a licensed Arizona real estate broker with at least 5 years' prior experience managing multi-unit residential properties, carry at least $1,000,000 in liability insurance, and post a $100,000 bond.
- Property manager independence & impartiality: The property manager cannot be financially, professionally, or personally related to any unit owner or board member, and must treat all unit owners consistently without discrimination.
- Association oversight & audit rights: The Association can inspect the property manager's facilities, procedures, and records at any time and audit compliance with the contract. If an audit reveals a discrepancy of 3% or more to the Association's detriment, the property manager must reimburse all audit costs and professional fees.
- Dispute resolution: Any disputes arising from the property management agreement are resolved through binding arbitration in Phoenix under American Arbitration Association rules, with arbitrators rendering a decision within 30 days.
