What Brookfield West I Homeowners Association's governing documents say
This is the Declaration of Covenants, Conditions, and Restrictions for Brookfield West I, a single-family home subdivision in Mesa, AZ, with 260 lots. The HOA maintains common areas (pools, basketball court, parking, playground, etc.) and enforces rules to protect property values. Owners are responsible for maintaining their home's exterior and must pay annual assessments.
- What you own & maintain: You own your lot and home outright. You must maintain the exterior, including fences, in good condition. The HOA can order maintenance and charge you if you don't comply.
- Architectural review: No building, fence, wall, or other structure may be erected, and no exterior changes made, without prior written approval from the Board or an architectural committee. If no decision within 30 days, approval is deemed given.
- Party walls & fences: Fences built on lot dividing lines are shared party walls. Repair and maintenance costs are shared proportionally by the owners who use them.
- Use restrictions: Properties are for single-family residential use only. Leasing of an entire lot to a single family is allowed, but no short-term or partial rentals are mentioned. No commercial activity is permitted.
- Pets: A reasonable number of generally recognized house or yard pets are allowed, but they must be kept as domestic pets, not for commercial purposes.
- Parking & vehicles: No parking, storage, or repair of vehicles (including boats, trailers, campers, motorcycles) on lots except within completely enclosed garages. Washing and waxing are allowed.
- Assessments & fees: Annual assessments are levied uniformly per lot, starting at a maximum of $300 per year (in 1985), adjustable by CPI or a 2/3 vote of members. Special assessments for capital improvements require a 2/3 vote. Unpaid assessments accrue 12% interest and become a lien on the property.
- Signs: No signs except one 'For Sale' or 'For Rent' sign no larger than 12" by 18". No billboards or advertising.
