What Red Mountain Corporate Center's governing documents say
Red Mountain Corporate Center is a commercial office park in Mesa, AZ, governed by a Declaration of Covenants, Conditions, and Restrictions. This document sets the rules for lot owners (businesses) in a professional office development — not a residential community. It covers use restrictions, common elements, assessments, and leasing rules for the eight planned lots.
- Permitted uses: Lots may be used only for corporate offices or professional services (e.g., law, medical, dental, accounting, real estate, veterinary, and similar uses, plus any use approved by Declarant or Association). No residential or other non-office uses allowed.
- What you own & maintain: Each lot includes land, the office building, and a designated number of parking spaces. The owner maintains the interior and exterior of the building (except designated parking spaces). The Association maintains the common elements (landscaping, streets, non-designated parking, etc.).
- Assessments & common expenses: Each lot owner pays a monthly share of common expenses (maintenance, insurance, reserves, etc.) proportional to their percentage interest in the common elements. Special assessments require 60% member approval. Late payments accrue 12% interest and a late charge up to 25%, and become a lien on the lot.
- Leasing & rentals: Lot owners have the absolute right to lease their lot or any portion, but the lease must be in writing, subject to the governing documents, and the owner remains jointly and severally liable for any tenant violations. No minimum lease term is stated, but the lease must comply with all rules.
- Architectural control: No exterior alterations, additions, signs, or structures (including fences, awnings, lighting) may be made without prior written approval of the Board (or Declarant while it owns lots). Interior alterations do not require approval. Landscaping changes also require approval.
- Parking & vehicles: Each lot has designated exclusive parking spaces; the rest are common. The Board can manage parking rules. Unsightly or nuisance vehicles may be prohibited. No temporary structures or trailers allowed without Board consent.
- Insurance: The Association must maintain casualty insurance on common elements (100% replacement cost), general liability ($5M per occurrence), and directors & officers insurance ($1M). Lot owners may obtain additional insurance for their own improvements and liability, but must not interfere with Association policies.
- Membership & voting: The Association has two classes: Class A (all owners except Declarant) and Class B (Declarant). Voting is proportional to each lot's common element percentage. Declarant gets triple votes per lot owned until conversion to Class A. Directors must be owners or their spouses/officers.
