What Camelot Country Club Estates's governing documents say
Camelot Country Club Estates Unit 3A is a single-family home subdivision in Mesa, AZ, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners, requiring homes to be used only as single-family dwellings and prohibiting business use.
- Use restrictions: Homes may be used only as single-family dwellings. No trade, business, or commercial activity is permitted on any lot.
- Pets & livestock: Horses, cattle, and poultry are not allowed. Domestic pets (such as cats or dogs) are permitted but must be kept fenced or leashed at all times, and must not create a nuisance or offensive odor.
- Maintenance & landscaping: Owners must keep their lots clean and free of trash, refuse, and inoperable vehicles. Lawns and landscaping must be properly maintained. If an owner fails to maintain landscaping, the property owners association may enter the lot, perform the work, and charge the owner, with a lien if unpaid.
- Architectural review: No structure or major improvement may be built until plans, specifications, and a plot plan are approved in writing by the developer or the property owners association. This restriction does not apply to the developer.
- Signs: No advertising signs, billboards, or other unsightly objects or nuisances may be placed on lots without written approval from the association or developer. One 'For Sale' or 'For Rent' sign no larger than 18 inches by 24 inches may be placed by the owner.
- Party walls: Walls built on lot dividing lines are party walls. Costs of repair and maintenance are shared by the owners who use the wall in proportion to use. If a party wall is destroyed by fire or casualty, any owner who used it may restore it, and other users must contribute. Negligence causing exposure to elements requires the negligent owner to bear all protection costs.
- Assessments & association: When the property owners association is formed, each lot owner automatically becomes a member and must pay assessments determined by the association, calculated as one share per lot. Unpaid assessments become a lien on the lot after notice is recorded.
- Duration & amendments: The restrictions run for 25 years from April 1, 1973, and automatically renew for additional 25-year periods unless 75% or more of lot owners agree to changes. Amendments require a written agreement of 75% or more of lot owners and must be recorded.
