What Casitas Montana Condominiums's governing documents say
Casitas Montana Condominiums is a condominium community in Mesa, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures. The declaration sets rules for residential use, rentals, pets, vehicles, signs, alterations, and more, binding all unit owners and their tenants.
- What you own & maintain: You own the interior finished surfaces of your unit (walls, floors, ceilings) and fixtures that serve only your unit. The association maintains and insures common elements like the building structure, grounds, and shared systems. You are responsible for maintaining your unit and certain limited common elements like your patio, exterior doors, and windows.
- Leasing & rentals: Units are intended to be owner-occupied, but the board may permit a lease for up to two years total if circumstances warrant. All leases must be in writing, subject to the declaration and rules, and the owner must provide the association with tenant info at least 10 days before lease start. The owner is liable for any rule violations by tenants.
- Pets: No more than two domestic pets (dogs, cats, or household birds) per unit. Dogs must be leashed outside and feces cleaned up. The board may adopt rules limiting pet height/weight, but only with a majority vote of members.
- Parking & vehicles: No mobile homes, trailers, boats, RVs, or inoperable vehicles may be parked on the property. Parking is only in designated spaces (some assigned as limited common elements). No repairs on common elements except emergencies. The board may tow violating vehicles.
- Signs & displays: Only one 'For Sale' or 'For Rent' sign is allowed, placed in a board-designated area with approved design. Seasonal, religious, or holiday decorations may be displayed on exterior doors; other outdoor displays require board approval, with a special allowance December 15–January 15.
- Home businesses: Home businesses are allowed only if they are not detectable from outside the unit, conform to zoning, do not involve visitors or solicitation, and do not create a nuisance or safety issue. Leasing a unit is not considered a business.
- Alterations & improvements: Nonstructural interior changes do not need board approval unless visible from the exterior. Any exterior alteration or structural change requires prior written board approval. The owner is responsible for damage caused by alterations.
- Assessments & voting: Common expense assessments are based on each unit's square footage. The board adopts the budget and sets assessments. Special assessments require approval by two-thirds of votes cast. Each unit has one vote in the association.
