What Colonial Manor-Mesa's governing documents say
Colonial Manor - Mesa is a condominium community (horizontal property regime) in Mesa, AZ, established in 1963. You own your individual unit (including an exclusive carport, storage room, and patio/balcony) and share ownership of common elements like the recreation area. The association maintains the common areas and enforces restrictions that run with the land.
- Residential use only: All units are restricted to high-class dwellings or apartments for residential use only. No business activities of any kind are permitted on the premises.
- Pets: No livestock or poultry may be kept on any premises, but household pets are allowed.
- Architectural review: All new construction, additions, alterations, and exterior painting require prior written approval from the Board of Directors. Plans and specifications must be submitted for aesthetic and suitability review, and approval may be denied for any reason deemed desirable.
- Signs: Only one 'For Rent' or 'For Sale' sign per unit is permitted. No other advertising signs, billboards, or unsightly objects may be erected or maintained.
- Assessments & fees: Each unit owner must pay monthly (or as invoiced) a pro-rata share of the association's actual costs for maintenance, insurance, taxes, management, and reserves. Invoices are due within 10 days; unpaid amounts become delinquent and subject to collection.
- Leasing & rentals: The association and other owners have a right of first refusal on any proposed sale, lease, or sublease. Written notice must be given to the association, which then has 30 days to match the offer. Leases shorter than six months are not mentioned but the right of first refusal applies to any lease.
- Maintenance responsibilities: The association maintains the recreation area, common areas, and carries hazard and liability insurance. Unit owners are responsible for their own unit, carport, and storage area, and must keep them in a manner satisfactory to the board. The association may enter and repair after 60 days' notice if the owner fails to maintain.
- Transfer restrictions: Membership certificates are non-transferable except upon sale of the unit. Any sale, transfer, or lease is subject to the right of first refusal, and the conveyance instrument must include a certificate of approval or an affidavit of non-exercise.
