This is a commercial covenants, conditions, and restrictions agreement (CCR) for the Hampton Center at Superstition Springs shopping center in Mesa, AZ. It applies to property owners of specified parcels (Price Parcel and SSILP Parcels) within the development, not to individual homeowners, tenants, or residents. The agreement establishes reciprocal easements, parking ratios, use restrictions, building height limits, maintenance obligations, and insurance requirements among the commercial parcel owners.
- Reciprocal easements: The property owners grant each other nonexclusive reciprocal easements for pedestrian and vehicular ingress/egress, parking, utilities, and signage over common areas and driveways within the shopping center.
- Parking requirements: Each parcel must maintain a minimum parking ratio of 5 spaces per 1,000 square feet of gross leasable floor area. Parking is only permitted for persons conducting business at the shopping center.
- Use restrictions: The shopping center may be used for any lawful retail/wholesale use common in shopping centers. Prohibited uses include massage parlors, adult book stores, pawn shops, movie theaters, bowling alleys, bars with over 50% liquor revenue, video arcades, night clubs, and billiard parlors. Car washes and health clubs are allowed only on SSILP Parcel 4, or on Parcels 1 or 3 if ancillary to a gas station.
- Building height limits: Building height is limited to 25 feet on SSILP Parcels 1 and 3.
- Maintenance responsibilities: Each owner must maintain their own buildings and common areas (including paved surfaces, curbs, lighting, landscaping, signage, and utilities) in good repair. If one owner fails to maintain, the other may perform maintenance after 10 days' notice and be reimbursed.
- Insurance requirements: Each owner must maintain public liability and property damage insurance with a combined single limit of $5,000,000, with property damage coverage of at least $1,000,000. The other owner must be named as an additional insured. Self-insurance is allowed if the owner has a net worth of at least $200,000,000.
- Construction & development standards: Owners must comply with the Project Manual by Ellerman & Schick, Inc. and the Superstition Springs Commercial Design Review Guidelines (dated April 23, 1993) to the extent practicable.
