This document is a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies only to a single parcel within the Mountain Horizons / Bella Via master-planned community in Mesa, AZ. That parcel is owned by a church (The Church of Jesus Christ of Latter-day Saints) and is used as a church facility. It is NOT a full set of rules for homeowners in the community. The rules here bind only the church property and its owner, not individual homeowners.
- Permitted use of the church property: The church property may only be used as a church or house of worship and for customary appurtenant uses (meetings, classes, community gatherings, offices, recreational activities). No other uses are allowed.
- Architectural review & seller approval: Any improvements to the church property require prior written approval from the seller (or its assignee) to ensure architectural and aesthetic harmony with the surrounding community. Approval cannot be unreasonably withheld, and specific church designs used at other nearby locations are pre-approved.
- Enforcement & who can enforce: Only the seller (or its assignee) and the church property owner (or its assignee) have the right to enforce this declaration. Individual homebuyers or homeowners in the broader community cannot enforce these rules.
- Term & termination: The declaration automatically expires 25 years after it was recorded (i.e., after late 2006, so by late 2031). It can also be terminated earlier by written agreement between the church owner and the seller (or assignee).
- What this document doesn't cover: This document does NOT contain typical HOA rules for residential homeowners in Mountain Horizons / Bella Via (such as pet limits, rental restrictions, lawn maintenance, parking rules, or assessment amounts). Those would be in a separate master declaration or HOA documents. This only governs the single church parcel.
