Palm Fountain Townhouses is a townhome (attached) community in Mesa, AZ, where owners hold fee simple title to their lot and unit, share common areas, and are governed by a homeowners association. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) defines the rules for owners, residents, and their guests.
- What you own & maintain: You own your lot and the townhouse unit built on it. The Association provides exterior maintenance (roofs, gutters, exterior surfaces, trees, shrubs, walks) except glass surfaces and patios. You are responsible for interior maintenance and all fixtures inside the unit.
- Party walls: Walls on the dividing line between units are party walls. If an owner damages a party wall, that owner must repair it at their own cost. If damaged by other causes, both adjoining owners share repair costs equally. Disputes are settled by arbitration.
- Architectural review: No building, fence, wall, or exterior addition may be built or altered without written approval from the Association's Board or an architectural committee. Plans must be submitted; approval is deemed given if no response within 30 days.
- Use restrictions: Properties are restricted to residential use only. No business activities are allowed. Pets (dogs, cats, or other household pets) are permitted but not for commercial breeding or keeping. One 'for rent' or 'for sale' sign of no more than 5 square feet per parcel is allowed.
- Maintenance & assessments: The Association levies annual assessments for common expenses and may levy special assessments with two-thirds vote of each membership class. Assessments are a lien on the property and personal obligation of the owner. Unpaid assessments accrue interest at 7% per annum.
- Parking & storage: Each townhouse owner is entitled to use up to 2 automobile parking spaces and 1 storage space, assigned by the Association. Parking and storage spaces are common elements not individually owned.
- Insurance: The Association must obtain property insurance covering all buildings (including units) for replacement cost, and a public liability policy. Owners may carry additional insurance for their unit and personal property. If a unit owner's insurance is obtained by the Association, the premium is a debt of that owner.
