What Pomeroy Estates's governing documents say
Pomeroy Estates is a standard single-family home subdivision in Mesa, AZ. These governing documents (called Covenants, Conditions & Restrictions or CC&Rs) apply to all lot owners and set rules for what you can build, how you can use your property, and what the neighborhood looks like. The rules are enforceable until at least 1980 and renew automatically every ten years unless a majority of owners vote to change them.
- Allowed buildings & use: Each lot can have only one single-family dwelling and a private garage or carport. No other buildings are allowed. The dwelling must be constructed only after a contract with a reliable contractor is in place. Multifamily is permitted only if it complies with local zoning.
- Minimum home size: The ground floor area of any single-family home must be at least 1,600 square feet (excluding open porches, pergolas, and attached garages). This minimum can be changed at any time by the Architectural Control Committee.
- Setbacks & fences: Front setbacks: at least 30.5 feet from front property line (25 feet for Lots 9 and 10). Rear setbacks: at least 25 feet (30.5 feet for Lots 9 and 10). Side setbacks: at least 7 feet from side lot line (3 feet for a garage or carport in the rear third of the lot). Fences and walls near the front are limited to 3.5 feet high; side and rear fences/walls no more than 6 feet. Hedges near the front may not exceed 3.5 feet within 30 feet of the front lot line.
- Animals: No livestock or poultry may be kept on any lot.
- Sanitary requirements: Before any residential use, water flush toilets must be installed, and all bathrooms, toilets, and sanitary facilities must be inside the building.
- Architectural control: An Architectural Control Committee (initially two officers of Zinferman Development Corporation) must approve all construction, alterations, and compliance with these restrictions. After 75% of lots are sold, owners may elect a three-member committee for three-year terms.
- Duration & amendment: These restrictions run with the land and automatically extend every ten years after January 1, 1980, unless a majority of lot owners vote to change them.
