Rose Garden is a 55-unit condominium community in Phoenix, AZ. You own your unit individually, share ownership of common elements like the building structure, grounds, and amenities, and the Association maintains them. Each unit gets one vote and pays an equal share (1/55th) of common expenses.
- Single-family residential use & home businesses: Units may only be occupied by a 'Single Family' (related or up to 3 unrelated people). Home businesses are allowed only if not detectable from outside, no customer visits, no more than 1 non-resident employee, and no hazardous materials.
- Leasing & rentals: Leases must be in writing, have an initial term of at least 6 months (unless Board approves shorter), and include a tenant acknowledgment of the Declaration. Owners must provide a copy of the lease to the Association at least 10 days before move-in.
- Pets: Only common household pets allowed, max 2 dogs per unit regardless of size, and no dog over 20 pounds unless it's a service/assistance animal. Pets must be leashed (max 6 ft) outdoors, and owners must immediately clean up waste.
- Parking & vehicles: Only 'Family Vehicles' (cars, small pickups, SUVs, etc.) may park. Commercial vehicles, RVs, boats, and trailers are prohibited unless reclassified by the Board. No inoperable vehicles or repairs allowed, and the Association may tow violators at owner expense.
- Improvements & alterations: Nonstructural interior changes do not need Board approval. Structural changes or any alteration visible from the outside require written Board approval. No penetrations of common element walls without permission.
- Common expenses & assessments: All 55 units share common expenses equally (1/55th each). The Board can levy regular and special assessments. Unpaid assessments create a lien on the unit.
- Limited common elements: Patios, stairs, entry walks, exterior doors/windows, and utility lines serving a single unit are 'Limited Common Elements' assigned to that unit. Units 1-37 share gas line costs equally unless the Board reallocates for excessive use.
