This is a Declaration of Restrictions for Skyrun on Southern, a single-family home subdivision in Mesa, AZ. It is a set of covenants, conditions, and restrictions (CC&Rs) that run with the land and bind all lot owners. There is no homeowners' association; enforcement is by lot owners through legal action. These rules cover what you can build, how you can use your property, and general neighborhood standards.
- Residential use & building type: All lots are for residential use only. Only one detached single-family dwelling per lot, not to exceed two stories, plus a private garage. No commercial, industrial, or multi-unit uses. Temporary structures (trailers, tents, etc.) can't be used as residences.
- Minimum dwelling size & quality: Dwellings must cost at least $12,000 (as of 1980 cost levels) and have a minimum ground floor area of 900 sq. ft. for one-story homes or 800 sq. ft. for multi-story homes (excluding open porches and garages). Construction must be of new materials and completed diligently.
- Architectural review: All building plans, including fences and walls, must be approved by the Architectural Control Committee (composed of named individuals) before construction. Approval/disapproval must be given in writing within 30 days of submission; if not, approval is deemed granted.
- Setbacks & building location: Buildings must comply with recorded setback lines. Minimum front setback: 25 feet; side street setback: 5 feet; interior side: 5 feet; rear: 25 feet. No building on lots smaller than 5,200 sq. ft. or less than 40 feet wide at the front setback line.
- Pets & animals: No livestock or poultry allowed. Dogs, cats, and other household pets are permitted, but not for commercial breeding or keeping.
- Vehicles & storage: Boats, campers, and house trailers must not be stored where visible from the street.
- Prohibited uses & nuisances: No noxious or offensive activities, no oil/mining operations, no dumping of rubbish. Trash must be kept in sanitary, non-conspicuous containers. Fences, walls, or hedges cannot exceed 6 feet in height, and corner lots have sight-line restrictions.
- Term & amendment: These covenants are effective for 35 years from recording (1980), then automatically renew for successive 10-year periods. A majority of lot owners can change or terminate the covenants by recording a written instrument.
