What Southern Point Casitas's governing documents say
Southern Point Casitas is a residential condominium community in Mesa, AZ — you own the interior of your unit and share ownership of the building's common areas, which the association maintains. The community initially has 6 units, with the developer able to add up to 84 more within 7 years. There is a gated entry, but the association does not guarantee security.
- What you own & maintain: You own the interior finishes (walls, floors, ceilings) and fixtures that serve only your unit. The association maintains all common elements, including the structure, exterior, and shared spaces. You are responsible for your unit's interior, your assigned garage, and your deck or patio.
- Pets: You may keep up to two domestic pets (dog, cat, fish, or bird) as household pets. No other animals or livestock are allowed. Dogs must be leashed outside your unit, and you must clean up after them. The board may adopt additional rules, including weight limits, with member approval.
- Leasing & rentals: Leases must be for at least 30 days. You cannot sublease or assign the lease. The owner must provide a copy of the lease (with tenant info) to the association at least 10 days before move-in, and the owner is responsible for any rule violations by tenants.
- Parking & vehicles: Each unit has one assigned garage (limited common element) and a parking space. Park only in your designated space. No vehicle repairs, inoperable vehicles, or parking on common areas. The association can tow violators at your expense.
- Alterations & improvements: Nonstructural interior changes do not need prior approval, but you are liable for any damage. Any structural change or change visible from the exterior requires board approval (and an engineer's certification for structural work). The board can impose conditions like insurance and security deposits.
- Use of decks & patios: Furniture and plants on decks must be neutral-colored and approved by the board unless the rules say otherwise. No storage of items like bicycles on decks. Barbeques are allowed but must be screened when not in use. Patio items cannot extend above the patio wall.
- Business use: Units are for residential use only. A home-based business is allowed only if it is not detectable from outside (no signs, visitors, noise, etc.) and complies with zoning. Renting your unit is not considered a business.
