What Superstition Meadows's governing documents say
Superstition Meadows is a single-family home subdivision in Mesa, AZ, subject to a Declaration of Restrictions (like CC&Rs) that run with the land. There is no homeowners association; these covenants are enforced by lot owners themselves. The restrictions set minimum home size, require architectural approval, and mandate a solid block rear fence.
- Property type & governance: The subdivision consists of 61 lots for single-family residences only. The restrictions are recorded and run with the land, enforceable by any lot owner. No HOA or common assessments exist; maintenance is individual.
- Use restrictions: Lots may be used only for single-family residences. No commercial activities, stores, offices, or similar uses are allowed. A model home or temporary office is permitted until all lots are sold.
- Building requirements: Each lot must have a single-family residence with a minimum of 2,000 square feet of livable area (excluding garages, porches, etc.). Only new construction is allowed; no moving buildings onto a lot. Construction must be completed without unreasonable delay.
- Architectural review: No structure may be started until the design, location, floor elevations, materials, walls/fences, and facing direction are approved in writing by designated persons (initially John K. Thomas or Daniel Rogers, later a committee elected by majority of lot owners). If no approval within 30 days of written request, approval is not required, but the structure must be in harmony with existing homes.
- Fence requirement: Upon completion of a dwelling, the owner must erect and maintain a solid block fence at least 6 feet high along the boundaries of the back portion of the lot, connecting to the dwelling on both sides. Chain-link fences are prohibited except around a pool in the rear.
- Livestock & pets: No livestock, horses, cattle, pigs, goats, sheep, chickens, pigeons, fowls, rabbits, or poultry may be kept on any lot. Domestic pets (e.g., dogs, cats) are not restricted by this document.
- Term & amendments: These restrictions run with the land until January 1, 2000, and automatically renew for successive 10-year periods. They may be amended by the written consent of owners of 75% of the lots, with the amendment recorded.
