What Southlin's governing documents say
Southlin is a standard single-family home subdivision in Mesa, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) recorded in 1989. These rules apply to all lot owners and residents, establishing a residential-only community with minimum home size, architectural controls, and maintenance assessments.
- Residential use & building limits: Each lot is limited to one single-family residence plus incidental accessory buildings. Minimum livable area is 1,800 square feet total; for one-story homes the ground floor must be at least 1,400 sq ft, and for multi-story at least 1,000 sq ft on the ground floor. No business, trade, or multi-family dwellings are allowed.
- Architectural review: All new construction, alterations, fences, and exterior color changes require prior approval from the Architectural Control Board (or Declarant until control transfers). Plans must be submitted; if not acted upon within 30 days, approval is deemed given unless the plans conflict with a specific restriction. The Board may charge up to $50 for plan review.
- Parking & vehicles: No trucks, buses, trailers, boats, campers, or similar vehicles may be parked in streets or driveways; they must be kept in garages or screened rear yards. This does not apply to passenger cars, station wagons, passenger vans, or pickup trucks. Abandoned or inoperable vehicles are prohibited, and visible vehicle repairs are not allowed. All residences must have an enclosed garage for at least two vehicles (carports prohibited).
- Pets & animals: A reasonable number of dogs, cats, birds, or fish may be kept as household pets if not a nuisance and not kept for commercial purposes. Pets must be fenced, leashed, or otherwise controlled; they may not wander freely. Swine, peacocks, chickens, pigeons, and geese are specifically prohibited.
- Landscaping & maintenance: Front yard landscaping must be completed within 180 days of occupancy. All lots must be kept neat and sightly, free of weeds and trash. The Board may enter and clean a lot after 10 days' notice and assess the cost as a lien. Fences on lot lines must be at least 6 feet high, of masonry, and maintained jointly by adjoining owners; reimbursement for half the cost is required from the neighbor when they build.
- Assessments & liens: The Board may levy assessments to cover actual costs of maintaining a lot if the owner fails to maintain it. Assessments are due within 10 days of notice; if unpaid, they become a lien on the lot and may be foreclosed. Delinquent assessments accrue 12% annual interest plus collection costs and attorney's fees. The lien is subordinate to first mortgages.
- Miscellaneous restrictions: All utility lines must be underground; driveways must be concrete or asphalt; outdoor high-intensity lighting must not disturb neighbors; antennas require Board approval; no temporary structures or trailers may be used as residences; signs are limited to mailboxes, nameplates, and one 'for sale' or 'for rent' sign no larger than 5 square feet. The CC&Rs automatically renew every 10 years after December 31, 2018, and can be amended by 70% of owners (or 60% after 2018). Declarant had exclusive amendment rights during its control period.
