What Sonoran Vista of Gilbert Homeowners' Association's governing documents say
Sonoran Vista of Gilbert is a standard single-family home HOA in Mesa, AZ. These bylaws govern how the association is run—board elections, meetings, assessments, and committees. They are one piece of the governing documents; the full rules (e.g., architectural review, pet policies, leasing) are in the separate Declaration (CC&Rs).
- Meetings & voting: Annual meetings are held at 7:00 p.m. on a fixed day each year. Special meetings can be called by the president, board, or by members holding 1/4 of the votes. A quorum is 1/10 of votes. Members may vote in person or by proxy.
- Board of Directors: The board has 3–9 members serving staggered terms. Directors are elected by secret ballot with cumulative voting. Vacancies are filled by the remaining directors.
- Assessments & liens: Annual and special assessments are levied per lot and secured by a lien. If unpaid for 20 days after due date, interest accrues at 18% per year and the association can foreclose or sue the owner. Owners cannot waive assessments by non-use.
- Committees: The board may appoint a Maintenance Committee, an Audit Committee (treasurer is ex-officio), and an Architectural Control Committee (5 members, at least one board member, governed by the Declaration). Other committees as needed.
- Records & inspections: Books, records, and financial statements are available for inspection by members and first mortgage holders during business hours. Members may purchase copies at reasonable cost. Mortgage holders may request a free audited financial statement.
- Amendments: Bylaws may be amended by a majority vote of a quorum of members. In case of conflict, the Declaration and Articles of Incorporation control.
- What this document doesn't cover: These bylaws do not contain specific rules about pets, leasing, parking, architectural changes, or age restrictions. Those restrictions are found in the separate Declaration (CC&Rs) and any rules adopted by the board.
