What Tamagi Terrace's governing documents say
Tamagi Terrace is a condominium community in Mesa, Arizona—you own your individual unit plus a shared one-third interest in the common building structure and grounds, which the Association maintains and insures through per-unit assessments. The community is governed by a 3-member Board elected annually by unit owners.
- What you own & maintain: You own your unit's interior, patio, and air conditioning system; you hold an undivided one-third interest in the common structure, grounds, and shared facilities. You maintain your unit's interior and termite control; the Association maintains exteriors, roof, landscaping, parking, and laundry areas.
- Use restrictions: Units are for single-family residential use only—no business, commercial, or institutional use, and no activities that are obnoxious or a nuisance to neighbors. Trash must be kept in screened containers; burning is prohibited.
- Pets: Commonly accepted household pets are allowed if properly licensed (if required), kept on a leash or restrained while being exercised, and not kept for commercial purposes.
- Architectural review: Any fences, walls, or improvements require prior written Association approval of plans and specifications; the Association may deny approval based on aesthetic suitability or other reasons. Approval is deemed given if the Association fails to respond within 30 days. Changes cannot exceed the original square footage of the residence.
- Assessments & fees: Annual per-unit assessments cover maintenance, repairs, and insurance; the initial maximum is $350/year, with increases up to 10% per year at Board discretion or larger increases with 66% member approval. Assessments collected monthly become delinquent after 45 days and accrue 6% annual interest; the Association can place a lien on your unit.
- Parking: Covered parking spaces are allocated to each unit by the Board; remaining spaces are reserved for guests and multi-car households.
- Party walls: Walls shared with neighboring units have specific rules: if you cause damage through your own or a guest's acts, you must repair it at your cost; otherwise the Association covers repairs. You cannot attach items to party walls, create noise through them, or penetrate them more than two inches.
- Insurance & damage liability: The Association carries fire, hazard, and liability insurance on all common areas and building exteriors, funded through assessments. You are responsible for insuring your own interior fixtures and personal property. If you cause damage to common areas or exterior, you must reimburse the Association for repairs; unpaid bills become a lien with 6% interest.
