Pueblo Viejo II is a single-family home subdivision in Mesa, AZ, governed by the Pueblo Viejo Homeowners Association. These CC&Rs apply to all lot owners and establish rules for property use, construction, architectural control, and mandatory assessments for common area maintenance.
- Property & building restrictions: Each lot is for one detached single-family dwelling (max 2 stories or tri-level). Minimum ground floor area: 3,000 sq ft for single-story, 2,400 sq ft for two-story/tri-level if total exceeds 3,000 sq ft. Construction must start within 18 months of purchase and be completed within 36 months; extensions possible with 2/3 vote. Delays incur $100/day penalty. Additions must be completed within 1 year or $50/day penalty.
- Architectural review: All exterior improvements (landscaping, buildings, fences, walls, trash areas, alterations) require written approval from the Board or an Architectural Committee. Plans must be submitted; if no decision within 30 days, approval is deemed granted.
- Maintenance assessments: Owners must pay annual assessments (max $1,200 per lot initially) and special assessments for capital improvements. Annual assessments can increase up to 10% per year without vote; above 10% requires 2/3 vote of each class. Assessments are a lien on the lot and a personal obligation; unpaid amounts bear 10% interest.
- Common areas & maintenance: Common areas include a lake (Tract B), dry land (Tracts A, C, D, D, E), tennis courts, and private roads (Tract E, F). The Association maintains landscaping, walks, recreational facilities, and pays the water assessment for the lake system. Owners have rights to use common areas, subject to fees and suspension for non-payment or rule violations.
- Vehicles & parking: Abandoned or inoperable vehicles may not be stored visible from other lots or streets. Motor homes, campers, trailers, and boats may only be parked in a garage. One 'For Sale' or 'For Rent' sign per lot is allowed; no other advertising signs.
- Business & livestock restrictions: No commercial activity, business, hospital, sanitarium, theater, or saloon is permitted on lots. No livestock or poultry may be kept.
- Enforcement & amendments: The Association or any owner may enforce restrictions via legal action. Violations do not affect existing mortgages. The declaration runs for 25 years, auto-renewing for 10-year periods. Amendments require a 7/8 vote of lot owners during the first 25 years, 75% thereafter.
