Three Falls Business Center is a commercial office park condominium in Mesa, AZ — each lot owner owns their building and a share of common elements, governed by an association. This document is for commercial lot owners, not residential homeowners.
- Permitted uses: Lots may be used only for corporate offices or professional services (e.g., architects, accountants, engineers, real estate, title insurance) and other uses approved by the Declarant or Association, subject to zoning. No residential use is allowed.
- What you own & maintain: You own your lot, office building, and a designated number of parking spaces. Common elements (landscaping, streets, non-designated parking, utility lines) are maintained by the association. You are responsible for all maintenance, repairs, and replacements within your lot and building interior.
- Assessments & fees: Each owner pays a monthly share of common expenses (including insurance, maintenance, reserves) based on their undivided interest in common elements (33.33% per lot). Late payments incur 16% annual interest and up to 25% late charge. Special assessments require 66% vote of each membership class.
- Parking: Each lot has designated parking spaces for exclusive use, plus shared non-designated spaces in common elements. The Board may assign and manage parking; the Declarant can reallocate spaces until all lots are sold. Parking of unsightly vehicles may be prohibited.
- Leasing & rentals: Lot owners have the absolute right to lease their lot or any portion, provided the lease is in writing and complies with governing documents. The owner remains jointly and severally responsible for tenant violations.
- Architectural control: No exterior changes, additions, or new structures (including signs, fences, awnings) may be made without prior written approval of the Declarant (if any lots owned) or the Association. Interior alterations are allowed without approval, but you are liable for any resulting damage.
- Insurance: The association carries master casualty, liability, and D&O insurance covering common elements (minimum $5M liability per occurrence). Owners must not carry policies that impair association insurance; they may obtain their own coverage for their lot and personal property.
