This is a 2003 amendment to the condominium declaration for Melody Villa, a condominium community in Phoenix, AZ. It changes the developer's future expansion rights and updates the maximum number of voting units. It does not contain the full condo rules; it only modifies specific sections of the original declaration.
- Future annexable property: The number of units that the developer may add to the condominium was increased from 16 to 26, divided into three phases (Units 37-40 & 49-52, Units 41-48, and Units 53-62). The developer must add the property within 7 years of the original declaration's recording date (March 2003), otherwise it automatically annexes unless a permanent withdrawal is recorded.
- Maximum number of units & votes: The total number of units in the condominium, including any future annexable property, will never exceed 62, and the total number of votes is capped at 62.
- Automatic annexation on sale or foreclosure: If the developer sells any part of the future annexable property to a third party, or if it is acquired through foreclosure, the property automatically becomes part of the condominium and subject to the declaration.
- Construction completion dates: Original construction was completed on approximately September 7, 1984 for most of the condominium, and December 8, 1986 for Phase Four of the future annexable property.
