Melody Terrace Condominium is a 10-unit condominium in Phoenix, AZ. This Declaration defines the rights and obligations of unit owners, the association, and residents. It covers use restrictions, leasing, pets, parking, maintenance, assessments, and architectural controls.
- What you own & maintain: You own the interior of your unit (finished surfaces). The association maintains common elements (building exteriors, roofs, private drive, parking, pool, spa, landscaping) and certain limited common elements (structural parts of patios, entryway gates). You must maintain your unit and your assigned limited common elements (patio, storage, doors, windows, A/C unit, hot water heater, etc.).
- Leasing & rentals: You may lease your entire unit only, for a minimum term of 90 days. Leases must be in writing and include a provision that the lease is subject to the condominium documents. You must provide a signed copy of the lease to the association at least 10 days before the lease starts.
- Pets & animals: Up to 2 dogs (any size) per unit, plus a reasonable number of other common household pets. Pets must be leashed (max 6 feet) outside the unit. Owners must immediately remove droppings from common elements. No pet structures visible from outside.
- Parking & vehicles: No commercial vehicles (including RVs, boats, trucks over 1 ton) may be parked except temporarily for loading/unloading (max 8 hours). The board assigns at least one covered parking space per unit. No vehicle repairs or inoperable vehicles (not moved under own power for 2 weeks). Towing of violating vehicles at owner's expense.
- Architectural review: Before any structural modification inside or any exterior-visible change (including window coverings, antennas, patio floor covering), you need board approval. The board may require plans, indemnity, insurance, and a security deposit. Nonstructural interior changes that don't affect mechanical systems generally do not need approval.
- Assessments & fees: Common expenses are allocated equally among all 10 units (10% each). The board adopts a budget annually and sets the common expense assessment. Special assessments may be levied. The association has a lien for unpaid assessments. A transfer fee may apply.
- Use & occupancy restrictions: Units are for single-family residential use only. Home businesses are allowed if not detectable from outside, no daily visitors, no more than one nonresident employee, and consistent with residential character. No nuisances, no temporary structures for residence, no time-sharing (occupancy less than 30 days).
