Tierra Este is a standard single-family-home subdivision in Mesa, AZ. These Covenants, Conditions & Restrictions (CC&Rs) apply to all lots in Tierra Este Park Unit Three and bind all owners. The rules govern what you can build, use, and maintain on your property.
- What you own & maintain: You own your lot and the home on it. You must maintain your property in compliance with these restrictions; the subdivision has no common area or association maintenance.
- Home construction & size: Only one detached single-family dwelling per lot. Minimum ground floor area of 1,300 square feet (excluding porches and garages). Homes must be masonry, insulated frame stucco, or painted frame. No moved-in buildings allowed.
- Setbacks & location: Front setback: at least 30 feet from the front property line. Side setbacks: at least 7 feet (or 3 feet for carports/storage) and 10 feet if side yard borders a street. Rear setback: conform to city regulations. Guest houses/garages may be located in the rear third of the lot.
- Fences & hedges: No solid wall or fence over 2½ feet high within the front yard setback. Side and rear fences or walls may be no more than 6 feet high. No hedge over 3 feet high within 26 feet of the front lot line.
- Land use restrictions: No livestock or poultry. No business, hospital, sanitarium, theater, or other commercial use. No residence may be used for any business purpose.
- Architectural review: No structure may be built or placed until its design, location, and materials are approved in writing by a committee (initially Virgil Roberts, later elected by owners). Approval is deemed given if no response within 30 days. All buildings must be in harmony with existing ones in the vicinity.
- Leasing & rentals: This document does not address leasing or rentals (no minimum term, no restriction).
- Duration & amendments: These covenants run with the land until January 1, 2003, and automatically extend for successive 10-year periods unless a majority of owners vote to change them.
