It is an ancillary declaration that requires each property (parcel) to pay an annual Replenishment Assessment to the Central Arizona Groundwater Replenishment District (CAWCD) for excess groundwater use. This obligation runs with the land and binds all current and future owners.
- Groundwater replenishment assessment: Each parcel is subject to an annual Replenishment Assessment based on its 'Parcel Replenishment Obligation' – the amount of groundwater delivered to the parcel in excess of the allowed use. The assessment amount is determined by CAWCD.
- Lien for nonpayment: If the assessment is not paid, CAWCD may place a lien on the parcel and pursue personal obligation against the owner, plus interest, costs, and penalties as provided by Arizona law.
- Amendment requirements: The declaration can be amended by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable statutes or regulations.
