Black Canyon Retreat is a single-family subdivision governed by a Declaration of Restrictions recorded in 1960. These are restrictive covenants that run with the land, binding all current and future lot owners. The rules cover lot use, building size, construction timelines, and animal keeping—but do not create a homeowners' association or impose assessments.
- Minimum home size: Each residence must have at least 800 square feet of ground floor space (including storage, excluding garage, carport, or outside porch).
- Density and utilities: No more than one dwelling unit per usable acre until an adequate, safe, approved central water supply is available.
- Construction deadlines: All buildings must be new construction and completed within 12 months of commencement.
- No temporary residences: No trailer, construction shed, basement, garage, tent, or similar structure may be used as a residence, either temporarily or permanently. Camping on any lot is prohibited.
- Pets and horses: Dogs, cats, other household pets, and up to one horse per permanent resident may be kept, but must be fenced or leashed at all times and not create a public nuisance.
- Property maintenance: Weeds, underbrush, unsightly growth, refuse piles, junk piles, and other unsightly objects are prohibited. Failure to comply gives the Declarant or its successors the right to enter and remove them at the owner's expense.
- Enforcement: Any property owner in Black Canyon Retreat may sue to enforce these restrictions or recover damages. A violation does not affect the lien of a recorded mortgage. If any restriction is invalidated, the rest remain in effect.
