What Dee’s Place's governing documents say
Dee's Place Well Co-Op is a non-profit property owners association in Oracle, AZ, operating a shared well for its shareholders. Shareholders are owners of single-family residences within a defined parcel, and each residence holds one share that transfers with the land. The bylaws govern water usage, fees, and maintenance of the well system.
- Shares & Voting: Each single-family residence has one share, which passes with the land and cannot be sold separately. Each share carries one vote, and a simple majority decides most matters.
- Officers & Meetings: No formal officers; a caretaker and an alternate are selected by rotation to oversee operations, collect fees, and manage the bank account. Annual meetings are held each January; special meetings can be called as needed.
- Fees: Monthly water service fee is $25 per residence, due in advance on the first of each month. Shareholders not yet drawing water pay $10 per month. Annual prepayment is accepted. Delinquent payments 60 days past due may be taken to small claims court, and water may be shut off until the debt and three months' advance (certified funds) are paid.
- Water Usage Restrictions: Well water is only for shareholders' domestic use. Filling pools over 2,000 gallons requires outside water. Sprinkler use limited to lawn areas not exceeding 1,000 square feet; hand-watering plants/trees allowed. Flood irrigation is prohibited. New or additional uses require shareholder vote.
- Repairs & Maintenance: Each shareholder must promptly repair leaks in their service line or plumbing. Damage caused by a shareholder or guest is their cost. The co-op handles repairs in easement lines except damage during building. Repairs over $50 need majority approval; if the well account lacks funds, the overage is split equally among shareholders.
- Water Testing & Sewage: The co-op conducts annual well water testing. No party may locate or relocate an individual sewage disposal system within 100 feet of the well.
- Amendments: Bylaws may be amended by a majority vote at the annual meeting, in person or by written proxy.
