What Purple Sage II's governing documents say
This document is a supplemental covenant for the Purple Sage II subdivision in Oracle, AZ — it does NOT contain typical HOA rules. Instead, it requires each parcel to be a member of the Central Arizona Groundwater Replenishment District (CAWCD) and pay an annual Replenishment Assessment based on groundwater use. The assessment is a personal obligation of the owner and a lien on the property. This is a water-supply compliance covenant, not a community rulebook.
- Water replenishment assessment: Each parcel is subject to an annual Replenishment Assessment set by CAWCD based on the Parcel Replenishment Obligation (the amount of Excess Groundwater delivered to the parcel). The assessment covers the cost of replenishing groundwater used beyond the allowed amount.
- Lien for nonpayment: If the Replenishment Assessment is not paid when due, it becomes a continuing lien on the parcel and a personal obligation of any owner who owned the parcel when the assessment came due. CAWCD can enforce the lien under Arizona law.
- Binding on all owners: By accepting a deed or acquiring any interest in a parcel, each owner automatically agrees to pay the Replenishment Assessment and is bound by the covenant. The covenant runs with the land.
- Amendment requirements: This Declaration can be amended or revoked only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property.
- What this document does not cover: This is not a full set of community rules. It contains no information about HOA fees, architectural controls, pet restrictions, leasing, parking, or any other typical homeowner association regulations.
