What Gateway Ranch's governing documents say
Gateway Ranch is a master-planned community in Oracle, AZ, but this document is not a full HOA rulebook — it is a specific covenant that makes the property 'Member Land' in the Central Arizona Groundwater Replenishment District (CAWCD). This ensures the development can obtain a certificate of assured water supply. Every property owner is automatically bound to pay certain water-related fees to CAWCD, and a lien may be placed on the property for nonpayment.
- Purpose of this covenant: This declaration qualifies the property as Member Land under Arizona law, allowing the developer to obtain a certificate of assured water supply. All current and future owners are bound.
- Mandatory fees to CAWCD: Each parcel is subject to three fees: (1) a Replenishment Assessment (annual, based on groundwater use), (2) a Replenishment Reserve Fee (one-time, due before a public report for sale/lease), and (3) an Activation Fee (one-time, also due before a public report). Amounts are set by CAWCD.
- Lien for nonpayment: If any fee is not paid when due, CAWCD may place a continuing lien on the parcel. The owner at the time the fee came due is also personally liable.
- Amending the covenant: This declaration can be changed only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total property area.
