Sunset Village West is a single-family home subdivision in Peoria, Arizona, governed by a Declaration of Restrictions that runs with the land, binding all owners from 1973 onward. These are not HOA rules but restrictive covenants enforced by property owners. The community is residential-only, with standards for construction, architecture, and use.
- Residential use only; no business: All lots are for single-family residential use only. No business, hospital, theater, or similar commercial activity may be conducted on any lot or in any residence.
- Construction standards: Only one detached single-family dwelling (one story max) plus a private garage or carport for up to 3 cars are allowed. Minimum ground floor area is 950 square feet (excluding porches, garage, etc.). New construction only; no moved buildings.
- Setbacks & fences: Houses must be 25–35 feet from the front property line, at least 10 feet from side street lines, and at least 5 feet from side lot lines. Front solid walls or fences over 2.5 feet high are prohibited; chainlink fences of any height are not allowed in front. Fences must be behind the front wall of the house (or 25 feet from street if no house yet).
- Architectural approval required: Before construction, the design, color, materials, and location must be approved in writing by a three-member committee. Initially appointed by the declarant, later by majority of lot owners. If no committee or no action within 30 days, approval is waived if the building harmonizes with existing structures.
- Pets and animals: No farm animals or fowl (chickens, horses, etc.). Dogs, cats, and other household pets are allowed, but not for commercial breeding and must not unreasonably interfere with neighbors or endanger health/welfare.
- Signs: Only one sign (up to 5 square feet) advertising the property for sale or rent is permitted. Declarant may use larger signs during development.
- Duration of restrictions: These covenants run until January 1, 2000, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them.
- What this document doesn't cover: No provisions for HOA dues, common areas, amenities, leasing/rental restrictions, parking rules, or an owners association. Enforcement is by lot owners through court action.
