Villa Rica is a standard single-family home subdivision in Tolleson, AZ — you own your lot and house, and a homeowners association (the Villa Rica Homeowners Association) maintains common areas and enforces rules. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that runs with the land, binding all current and future owners.
- What you own & maintain: You own your entire lot and the house; the association maintains common areas (owned by the association). You must keep your lot and buildings in good repair, and no graffiti or disrepair is allowed.
- Leasing & rentals: All leases must be in writing, for the entire residence and lot, with a minimum term of 30 days. You must notify the board with the tenant's name, lease term, and your current address.
- Pets: A reasonable number of common domestic house or yard pets are allowed, but not for commercial breeding. No animal may create a nuisance. Dogs must be leashed (max 6 feet) and under control when off your lot. You must clean up droppings; pet structures must not be visible from neighboring property.
- Architectural review: Any exterior alteration (color, additions, sheds, patios, fences, etc.) requires prior written approval from the Architectural Committee. Submit plans; if no response within 30 days, approval is deemed given. The Declarant (builder) is exempt from architectural control.
- Parking & vehicles: Park vehicles in garages or driveways. No inoperable vehicles visible from neighboring property. No major vehicle repairs on front lots or streets. Trailers, campers, boats, and RVs may be parked on or adjacent to driveways or in rear yards only. No mobile homes allowed.
- Signs: No signs without approval, except: one small residential identification sign (≤80 sq in), one 'for sale' or 'for rent' sign (≤5 sq ft), signs required by legal proceedings, and signs installed by the Declarant.
- Assessments & fees: Annual assessments are set by the board, subject to a maximum that can increase by CPI or 10% (whichever greater) without a vote. Assessments become a lien if unpaid after 10 days, with 12% annual interest and a $5 monthly late fee. Special assessments require a 2/3 vote of members. Never-occupied lots pay 25% of the rate for occupied lots.
