West Olive Farms is a single-family residential subdivision in Peoria, AZ, governed by a Declaration of Restrictions (Covenants, Conditions & Restrictions) recorded in 1972. These restrictions run with the land and bind all lot owners. The subdivision is not a condominium or HOA — there is no association, and no monthly assessments are mentioned. Instead, the rules control how lots can be used and built upon.
- Building & land use: Lots are restricted to single-family residences of conventional construction with a minimum of 1,200 sq. ft. of interior space. A garage or carport is required, and a stable, tack room, or livestock shelter is allowed. No building may be placed closer than 40 feet from front and rear lot lines and 30 feet from side lot lines. No dwelling may be erected without prior written approval of the Company (the original developer) as to size, condition, position, and appearance. Plans and a site layout must be submitted; approval or rejection must occur within 30 days.
- Animals & livestock: Horses, poultry, and livestock are permitted, provided facilities are maintained in a clean, neat, orderly fashion and comply with Health Department standards. Physical facilities must be at least 100 feet from the front property line and located in the rear yard. Stables and other animal shelters must be harmoniously designed and cannot be built of used or inferior materials.
- Fences & landscaping: Fences must be of woven wire, pipe, or wood material, kept in good repair, and wood fences must be painted or stained. Front yards must be landscaped (planted grass or artificial lawn) within 120 days of occupancy or as specified. All lots must be maintained in clean, orderly, weed-free condition.
- Vehicles & machinery: No tractors, trucks, blades, farm implements, or machinery may be parked forward of the front building wall. All such equipment must be stored in an enclosed structure at least 100 feet from the front property line and 40 feet from the rear property line. No clotheslines, washing machines, or other appliances may be visible from adjoining properties.
- Prohibited activities: No noxious or offensive activity allowed. No commercial business, servicing, repairing, storing, buying, or selling may be carried on any lot. Nothing may be done that becomes an annoyance or nuisance to the community. Lots may not be subdivided further.
- Irrigation ditches & easements: Lot owners must maintain any irrigation ditches crossing their lots and all associated equipment. No bridges or permanent crossings may be constructed over ditches. Easements for utilities, drainage, and irrigation ingress/egress are reserved; no structures or plantings may interfere with those easements.
