What Westfield Gardens's governing documents say
Westfield Gardens is a single-family home community in Peoria, AZ, governed by a homeowners association (HOA). Each owner owns their lot and home, and the association maintains common areas like the pool, clubhouse, and landscaping. All owners are automatically members of the HOA and pay assessments for common expenses.
- What you own & maintain: You own your lot and the single-family residence on it. The association maintains all common areas (tracts A-D, including private drives, open areas, pool, clubhouse). You are responsible for interior decorating, non-structural interior alterations, and maintaining your lot in good condition.
- Leasing & rentals: Leases must be in writing, for a minimum of 30 days, and cover the entire lot. No transient or hotel use is allowed. A copy of each lease must be given to the association before the term starts. The lease must state that violating the governing documents is a default.
- Pets: Only commonly accepted household pets are allowed. No breeding is permitted. Pets that create a nuisance may be required to be removed.
- Architectural control & alterations: Any exterior change (building, fence, wall, antenna, awning, sign, landscaping, grade, drainage) visible from another lot or common area requires advance written approval from the board or an architectural committee. Non-structural interior changes do not need approval.
- Party walls & shared structures: Walls, fences, or columns on lot boundaries are party structures jointly owned by adjacent lot owners. Repair costs are shared equally unless damage is caused by one owner, who then bears the full cost. Entry easements exist for maintenance.
- Parking & vehicles: The board may prohibit vehicles that create noise or are unsightly. Storage of trailers or unsightly vehicles is prohibited. Parking is at owner's risk; the association is not liable for vehicle damage.
- Signs & outdoor items: Only a small 'For Sale' or 'For Lease' sign (max 4 sq ft) and a name/address sign are allowed. No spotlights, floodlights, window air conditioners, window treatments visible from outside, antennas, clotheslines, or temporary structures (except those approved by the board).
