Candle Creek is a single-family residential subdivision in Phoenix, Arizona, governed by a homeowner association. Each owner owns their individual lot and detached home; the association maintains the shared common areas, funded by per-lot assessments, and enforces architectural and use restrictions.
- What you own & maintain: You own your detached house and lot. You are solely responsible for maintaining your home's exterior (roof, siding, paint), all interior systems and utilities, landscaping, lawn, trees, and irrigation. The association maintains all common areas.
- Annual & special assessments: The initial maximum annual assessment is $180 per lot (through December 31, 1993); thereafter the board may increase assessments by no more than the greater of 10% or the Consumer Price Index increase, unless members approve a higher increase by two-thirds vote. Late payments incur a $50 charge plus 18% annual interest.
- Landscaping requirements: All visible portions of your lot must be landscaped within 120 days of purchase, with a plan approved by the Architectural Committee. Landscaping must thereafter be maintained in a neat, clean, attractive condition and kept free of weeds, trash, and overgrowth.
- Architectural review: The Architectural Committee must approve landscaping plans, roofing changes, fences, walls, antennas, window coverings, and other exterior modifications before installation to ensure compatibility with community standards.
- Voting & membership during Declarant Control: Initially, owners (Class A members) have 1 vote per lot, while the Declarant, Beazer Homes, (Class B member) has 3 votes per lot. The Declarant's enhanced voting control ends when Class A votes equal or exceed Class B votes, or 6 years after the first lot sale—whichever occurs first.
- Use restrictions: Only single-family residential use is permitted. Business operations, commercial vehicles, noxious activities, and unauthorized animals are prohibited. Detailed restrictions govern signs, drilling, machinery, fuel tanks, hazardous materials, and other non-residential uses.
