What 35th Avenue & Union Hills's governing documents say
This document is a set of parking and vehicle rules adopted by the 35th Avenue & Union Hills Property Owners' Association (POA) for a development in Phoenix, AZ. The rules bind all property owners and their employees, tenants, or invitees ("Permittees"). This is not a full set of CC&Rs; it only addresses parking and vehicle enforcement.
- Parking on circulation drives: No parking is permitted on the development's internal circulation drives (see site plan in Exhibit B).
- Employee vehicle reporting & decals: Each owner must provide a list of all vehicle license numbers for employees working in the development (due within 30 days of the rule, then 10 days after any change). The association may require employee vehicles to display a parking decal. Failure to maintain current info incurs a $50 administrative charge per violation.
- Employee parking restrictions: Employees must park only on their own owner's parcel. The association can require decals and set related policies.
- Walgreens parcel access: Only the owner of the Walgreens parcel and its permittees may park on that parcel. All other owners and their permittees are prohibited from parking there.
- Enforcement & towing: The association may enforce these rules by towing or booting vehicles at the owner's expense. Any enforcement costs (including the $50 charge) become an assessment against the owner, collectible under the underlying Agreement.
- What this document doesn't cover: These rules are limited to parking and vehicles. They do not cover other common HOA topics such as noise, pets, landscaping, architectural review, leasing, or use of common areas beyond parking.
