What Apex Condominium Association's governing documents say
Apex Condominium Association is a condominium community in Sun City, Arizona. This document is an amendment to the Declaration of Restrictions, adopted in 1993 with later modifications, showing changes to governance procedures and incorporating Arizona state condominium law. It binds unit owners on property ownership, sales, assessments, and governance.
- Condominium ownership: You own your individual unit; the Association owns and maintains common elements including the building structure and grounds. Each unit is separately taxed and assessed.
- Unit alterations: You cannot change the exterior appearance of your unit or common elements without written Board permission. Interior modifications are allowed if they don't impair structural integrity or mechanical systems.
- Selling your unit: The Board must be notified in writing of any sale, and the prospective buyer must receive a copy of the Declaration of Restrictions. A Board meeting with the prospective buyer is required before the sale closes.
- Assessments and liens: The Board levies annual assessments for common expenses. Unpaid assessments create a lien on the unit that can be foreclosed. Special assessments may be levied for damages caused by the unit owner's misconduct.
- Insurance: The Association maintains property insurance (minimum 80% of actual cash value) and liability insurance. Insurance proceeds are held in trust and used for repairs; unit owners receive surplus proceeds only after full repair or if the condominium is terminated.
- Meetings and voting: The Association holds at least annual meetings with a 25% quorum requirement. Each unit votes based on its allocated interest; proxy voting is allowed but proxies expire after one year unless marked irrevocable.
- Board governance: The Board can adopt and amend budgets, with unexpended funds becoming capital improvement funds. Board members can be re-elected for unlimited consecutive terms if duly elected by membership.
