Rancho Encanto Terrace is a single-family home subdivision in Phoenix, AZ — you own your house and lot, and the homeowners' association (HOA) manages shared common areas and enforces rules to protect property values. This Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) is the main rulebook for the community, binding all owners, their tenants, and guests.
- What you own & maintain: You own your lot and the house on it. The association maintains the common area (initially Tract A) and has rights to maintain certain areas near your lot like landscaping in rights-of-way. You must keep your lot neat, weed-free, and landscaped (front yard within 6 months of ownership).
- Leasing & rentals: Leases must be in writing, for the entire lot and residence, with a minimum term of 30 days. A copy must be provided to the association, and the lease must require the tenant to follow the CC&Rs. Short-term rentals under 30 days are prohibited.
- Pets: Common household pets (dogs, cats, etc.) are allowed, but no livestock or poultry. No commercial breeding. The architectural committee decides if the number of pets is 'unreasonable' — no fixed limit in the document. Pets must be leashed or in a fenced yard, and pet structures must not be visible from neighboring property.
- Parking & vehicles: Vehicles must be parked in garages, carports, or driveways. No on-street parking overnight except for temporary visits. No inoperable or unsightly vehicles visible from neighboring property. Trucks over 1 ton, boats, RVs, and trailers are prohibited unless used regularly for basic transportation and meeting size limits (e.g., RVs under 7 ft high, 18 ft long).
- Architectural review: Any exterior changes (construction, painting, landscaping, fences, etc.) must be approved in writing by the architectural committee before starting. Submit plans; if no decision within 45 days of complete submission, approval is deemed given. The committee can charge a review fee.
- Assessments & fees: Annual assessments are set by the board. The maximum annual assessment in 2004 was $324 per lot, increasing automatically each year by the greater of 10% or CPI (but no more than 20% year-to-year without majority owner approval). Special assessments require 2/3 owner vote. A transfer fee and an initial reserve payment (1/6 of annual assessment) are due from new owners.
