Rancho Encanto is a single-family home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions (1974). These covenants run with the land and bind all lot owners. They set rules for residential use, building standards, and lot maintenance.
- Residential use only: Each lot must be used solely for residential purposes. Only one detached single-family dwelling is allowed, no taller than two stories or 30 feet.
- Building size & height: Minimum habitable area: 850 sq ft for one-story homes, 1,200 sq ft for homes with more than one story. All structures must be new construction (no moved buildings).
- Setbacks & fencing: Front setbacks: 20–50 feet from property line; rear setbacks: 25 feet; side setbacks: 7 feet (3 feet for open porches/carports). Corner lots have sight-line restrictions. Chain link or wire fencing is prohibited.
- Pets: Dogs, cats, and other household pets are allowed, but may not be kept for commercial purposes. No livestock or poultry.
- Vehicles & parking: No inoperable vehicles or those under repair may be parked within the front setback unless enclosed by a fence. Jalopies, racing cars, and trucks not used in everyday business are also restricted.
- Signs: Only one professional sign (max 1 sq ft), one for-sale or for-rent sign (max 5 sq ft), and builder signs during construction are permitted.
- Architectural control: All building plans must be approved by a committee of three (initially appointed by declarant, later elected by residents after 90% of lots are sold). Approval must be in writing.
- Term & enforcement: Covenants run for 30 years from recording, then auto-renew every 10 years unless owners of a majority of lots vote to change them. Violations can be enforced through legal action.
