What Algodon Center's governing documents say
Algodon Center is a master-planned commercial community in Phoenix, AZ — a mixed-use development for office, technology, medical, retail, resort, hotel, and entertainment uses, not residential. This Master Declaration sets the overarching rules for all lots; each lot's specific permitted uses and additional restrictions are defined in separate Tract Declarations. Owners (commercial property owners) and occupants must comply.
- Permitted & prohibited uses: Lots may only be used for the land use classifications set in their Supplemental Declaration or Tract Declaration. Heavy industrial uses and warehousing/transportation as primary uses are prohibited. Also banned: adult uses, cemeteries, outdoor vending (except ATMs), family planning clinics, research involving animals, telecommunication towers, and others. Lot 16 is restricted to hotel use for 10 years; other Medical Office Park Lots cannot be used for temporary lodging (hotels/motels) for up to 40 years unless Lot 16 is not actively operated as a hotel.
- Design review & approvals: No improvements (buildings, landscaping, signs, etc.) may be built or altered without prior written approval from Declarant or the Design Review Committee, following Design Guidelines. The committee may withhold approval for aesthetic reasons, even if code-compliant. Non-conforming work may be stopped; the association can enter the lot to cure violations and charge the owner as a Special Assessment.
- Assessments & liens: All owners pay Regular Assessments to cover common expenses, calculated based on a formula using deeded area and adjusted lineal frontage. Special Assessments may be levied for enforcement or emergencies; Reconstruction Assessments for rebuilding common areas after casualty. Assessments are a continuing lien on the lot, junior only to first mortgages. Late payment incurs interest at default rate plus costs.
- Maintenance & insurance: Owners must maintain their improvements in first-class condition (including cleaning windows, removing graffiti within 5 days). Owners must carry commercial general liability insurance of at least $5,000,000. The Master Association maintains common area improvements and landscaping in easements; it also carries blanket liability and property insurance for common areas.
- Easements: The Master Association has non-exclusive easements for ingress/egress and maintenance. The Design Review Committee has an easement for inspections. Declarant reserves rights for signage, drainage, utilities, and temporary construction easements. All easement exercise requires minimal interference and restoration upon completion.
- What this document doesn't cover: This Master Declaration provides a framework; it does not list exact assessment amounts, specific Design Guidelines, architectural standards, or rules for individual lots. Those will be in future Supplemental Declarations or Tract Declarations. There are no rules about residential uses, pets, leasing terms, or parking (beyond on-street restriction in common area rules).
