What Young America West's governing documents say
Young America West is a standard single-family home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions (CC&Rs) from 1983. These rules apply to all lot owners and are designed to maintain a consistent residential character. Key restrictions cover lot use, construction standards, and property upkeep.
- Land use & building type: Lots may only be used for residential purposes. Only one detached single-family dwelling (max 2.5 stories) plus a private two-car garage or carport per lot. No businesses, hospitals, or sanitariums.
- Architectural review: All construction, alterations, or additions must be approved in writing by the Architectural Control Committee before starting. If the committee fails to respond within 30 days of plan submission, approval is deemed given unless a lawsuit is filed.
- Minimum home size: The floor area of the dwelling (excluding porches, garages, carports, and patios) must be at least 800 square feet, unless the committee approves a smaller size.
- Setbacks & fences: Buildings must be set back at least 25 feet from the front lot line, 7 feet from interior side lines, and 7 feet from side lines adjacent to a street. Fences higher than 6 feet are not allowed across the rear property line; within front or side street setback areas, fences cannot exceed 2 feet 6 inches. Side lot line fences may be up to 6 feet.
- Pets & livestock: Dogs, cats, or other household pets may be kept as long as they are not bred or maintained for commercial purposes. Horses may be kept for single-family use, subject to county regulations and committee approval. No other livestock or poultry is allowed.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers is permitted in the street. Only passenger cars and pickup trucks may be parked in open carports. Abandoned or inoperable vehicles cannot be stored where visible from other lots or streets.
- Property maintenance: All lots must be kept free of rubbish and weeds, and yards must be cultivated and planted to maintain a neat appearance. If an owner fails to maintain their lot, six neighbors acting together may clean it up and file a lien for the cost if the owner refuses to pay within 30 days.
- Term & enforcement: These restrictions run with the land until January 25, 2013, and automatically renew for successive 10-year periods unless a majority of owners vote to amend or revoke. Any lot owner can sue to enforce the restrictions.
