Braewood Park is a single-family home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions (CC&Rs) recorded in 1974. These rules apply to all lot owners and are designed to maintain a uniform residential character. The covenants run with the land and automatically renew unless a majority of owners amend them.
- Lot use & building type: Lots are for residential use only. Only one detached single-family dwelling, not exceeding 2½ stories, plus a private two-car garage is allowed. Minimum floor area (excluding porches, garages, etc.) is 900 square feet. No prefabricated or temporary buildings as residences.
- Architectural review: Plans and specifications for any building or alteration must be approved in writing by the Architectural Control Committee. If the committee fails to act within 30 days after submission (and no suit is filed before completion), approval is deemed given.
- Setbacks & building location: Buildings must be at least 20 feet from front lot lines, 5 feet from interior side lines, and 10 feet from side lines adjacent to streets. Eaves, steps, and open porches are not counted as part of the building for setback purposes. Side yards for detached garages must comply with county requirements.
- Fences & walls: No fence or wall over 6 feet high across the rear property line. Within front or side street setback areas, fences cannot exceed 2 feet 6 inches. All fences need committee approval of design and style.
- Pets & livestock: No animals, livestock, or poultry may be raised, bred, or kept for commercial purposes. Dogs, cats, or other household pets are allowed as long as not kept for breeding or business. Horses may be kept for single-family use, subject to county rules and committee approval.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers in the street. Vehicles other than passenger cars and pickups may not be parked in open carports. Abandoned or inoperable vehicles must not be stored visible from any other lot or street.
- Signs: No sign visible from the public except one sign of no more than 5 square feet advertising the property for sale or rent, or signs approved by the committee or placed by the developer during development.
- Term & enforcement: These covenants are binding until August 1, 2003, and automatically renew for successive 10-year periods unless a majority of lot owners amend or revoke them. Any owner can enforce the restrictions through legal action.
