Alteza Garden Office Condominiums is a non-residential (commercial office) condominium in Phoenix, AZ. Each owner holds fee simple title to a unit (a building) and an undivided interest in common elements. This declaration governs the use of units for permitted commercial office purposes and establishes the association's authority.
- Permitted use: Units may be used only for private commercial office use consistent with zoning. Unit 3 is specifically prohibited from providing massage, physical therapy, or chiropractic services, and from operating outside 7:00 a.m. to 7:00 p.m.
- What you own & maintain: You own the entire physical building (unit), including interior, exterior, roof, and foundation. You are responsible for maintenance, repair, and replacement of your unit, including the roof and all exterior elements. The association maintains the common elements (landscaping, parking, common bathrooms, etc.) and designated parking spaces.
- Assessments: Annual assessments fund common element operation and reserves. Maximum annual increase is the greater of 12% or CPI change. Special assessments for capital improvements or extraordinary expenses require 50% vote of members present. Delinquent assessments accrue 10% late fee and 24% annual interest, and create a lien on the unit.
- Exterior changes & signs: Exterior color, style, or condition changes require prior approval from the Architectural Committee. No signs visible from neighboring property without approval (Declarant during control period, Architectural Committee after).
- Parking: Parking spaces may be designated for exclusive use of a unit (Designated Spaces) as shown on the Parking Plan. The association maintains those spaces and can allocate maintenance costs proportionately. Undesignated spaces are first-come, first-served.
- Nuisance & hazardous materials: No noxious or offensive activities, nor any nuisance interfering with other owners' quiet enjoyment is allowed. Hazardous wastes, asbestos, and petroleum products (except janitorial supplies) are prohibited on any unit or common elements.
- Insurance: The association carries general liability and property insurance on common elements ($1M minimum liability). Each owner must carry all-risk casualty insurance on their unit and comprehensive general liability insurance.
- Subdivision restrictions: Units may not be further subdivided except that during Declarant control, additional condominium regimes within a building may be created if subordinate to this declaration.
