Ownership comes with mandatory association membership and monthly assessment obligations.
- What you own & maintain: You own your townhouse interior and land. The association maintains the exterior of buildings (including party walls), landscaping, streets, recreational facilities, and utilities; you maintain your interior, patio, and are responsible for windows and roof replacement. Exterior color changes and structural alterations require board approval.
- Party walls: Walls between townhouses are maintained by the association. If damage is caused by your acts, family, guests, or tenants, you must repair it at your own cost. If caused by wear, weather, or other causes outside owners' control, both adjoining owners share repair costs equally. Modifications to a party wall require your neighbor's written consent.
- Pets: Dogs, cats, and other household pets are allowed, provided they are not kept or bred for commercial purposes.
- Vehicles & parking: Motorcycles and similar loud vehicles require board approval to operate in the community. Trucks, trailers, campers, boats, and similar vehicles must be parked only in enclosed garages; only automobiles and bicycles are permitted in open carports. Garage doors must remain closed except during entry/exit.
- Use & activity restrictions: The community is restricted to residential use; no business activities are permitted. Advertising signs are prohibited except one "For Sale" or "For Rent" sign per unit. All utilities, garbage cans, equipment, and service yards must be screened from view. Clotheslines must be confined to rear patio areas.
- Architectural review: Any buildings, antennas, exterior additions, alterations, fences, or landscaping changes must be submitted for written approval by the board's architectural committee before work begins. The board has 30 days to review; if no response within 30 days, approval is deemed granted. All subsequent alterations require prior written approval.
- Assessments & liens: You must pay monthly assessments (1/12 of the annual amount set by the board). The initial maximum annual assessment was $360 per townhouse (as of 1974); increases beyond this require a 2/3 vote of all members. Unpaid assessments accrue 6% annual interest and become a lien on your townhouse, enforceable through foreclosure.
