During construction, dust control and debris removal are required. Damage or deterioration must be repaired or the structure removed promptly.
- Easements: Declarant, the Council, and utility providers hold extensive easements over lots for access, maintenance, utility installation, drainage, and enforcement. Owners cannot interfere with these easements. Temporary construction easements may be granted.
- Assessments & association (if created): Declarant may create an association to manage common areas and levy assessments. If established, owners must pay Common Area Assessments, Special Assessments (approved by majority vote plus Declarant during control period), and Benefited Assessments (e.g., for liens or special services). Assessments are a personal obligation and may become a lien on the lot.
- Enforcement & remedies: Declarant, the Council, and owners may enforce covenants through legal and equitable remedies, including specific performance and injunctions. Self-help is allowed after notice (or immediately for emergencies). Delinquent assessments accrue interest and may be secured by a recorded lien forecloseable like a mortgage.
