Arabian Crest IV is a single-family attached home (townhome) community in Phoenix, AZ, governed by a homeowners' association. Each owner owns their lot and house, with party walls between units. The association maintains a small common area consisting of palm trees in the 54th Street right-of-way.
- What you own & maintain: You own your house, lot (including yard and landscaping), and interior. The association maintains only the common area (palm trees and related systems). You are responsible for all upkeep, repair, and maintenance of your house and lot, including termite control.
- Party walls: Walls built on the dividing line between lots are party walls. Owners sharing a wall split repair costs equally, unless damage is caused by one owner's negligent act, in which case that owner bears the full cost. Altering a party wall requires written consent from the adjoining owner, which cannot be unreasonably withheld.
- Architectural review: An Architectural Control Committee (three board-appointed members) must approve any modification, alteration, building, landscaping, or exterior painting before work begins. Approval may be granted or denied in the committee's sole discretion. If the committee fails to act within 30 days of submission, approval is deemed granted.
- Assessments: Each lot (except developer lots) pays an annual assessment and may be subject to special assessments approved by two-thirds of voting members. The annual assessment is calculated as each lot's pro rata share (1/32nd) of common area costs and association expenses. Assessments can increase annually by the CPI increase, and further increases require a 2/3 vote. Late payments accrue interest at 18% per annum and can become a lien on the property.
- Insurance: The association must carry liability and hazard insurance on the common area (palm trees). Each owner is required to carry replacement-cost insurance on their own house. The association may also purchase fidelity bonds for its officers and directors.
