What Remmington Estates's governing documents say
Remmington Estates is a single-family home subdivision in Scottsdale, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) recorded in 1994. These rules apply to all lot owners and are enforced primarily by an Architectural Committee; there is no homeowners' association described in this document.
- Architectural review: All exterior improvements, including buildings, fences, walls, and changes to existing structures, must be approved in writing by the Architectural Committee before construction. Plans and specifications must be submitted in duplicate, and a fee may be required. The Committee has 30 days to approve or disapprove; if it fails to act, approval is presumed denied. The Committee may grant variances at its sole discretion.
- Lot use & building standards: Lots are restricted to single-family residential use only. Minimum dwelling size is 1,850 square feet (exclusive of garage) for both one- and two-story homes. No temporary structures, trailers, tents, or prefabricated homes are allowed. Maximum height is two stories. Setbacks and orientation must comply with the Committee's guidelines.
- Pets: Dogs, cats, and other common household pets are allowed, but they may not be bred or kept for commercial purposes, and cannot become a nuisance. No other animals, livestock, or poultry are permitted.
- Parking & vehicles: Boats, campers, trucks, trailers, motor homes, and recreational vehicles may not be stored or parked on a lot where they are visible from the street or an adjoining lot. No advertising signs or billboards are allowed (except by the developer during construction and sales).
- Party walls & maintenance: Owners of lots sharing a party wall (common wall) have rights and obligations for its maintenance and repair. If damage is caused by an owner or their agents, that owner must repair at their own cost. For other damage, adjoining owners share the cost proportionally. Each owner is also responsible for painting, repairing, and maintaining their side of perimeter walls and all landscaping on their lot, including adjacent public right-of-way areas.
- General upkeep & nuisances: Lots must be kept clean and free of rubbish, trash, and unsightly materials. Clotheslines, garbage cans, and storage piles must be screened from view. No exterior lights may cause glare or unreasonable interference with neighbors. No structure may be occupied until fully completed and an occupancy permit issued.
- Amendments & duration: The covenants run with the land for 20 years from the recording date (1994), automatically renewing for successive 10-year periods. Amendments require recording a certificate signed by the Declarant (if it still owns at least 1/4 of the lots) or by owners of a simple majority of lots.
