Arcadia Villa Rey Townhomes is a 16-unit condominium community in Phoenix, AZ — you own your individual townhome unit and hold an undivided 1/16th share in common areas (building structure, landscaping, parking, pool, recreation). The Association maintains common areas and building exteriors through per-unit assessments.
- What you own & maintain: You own your unit's interior (walls, floors, ceilings, patio, storage area, AC system and ductwork). You are responsible for maintaining your unit's interior and all systems within it. The Association maintains the building exterior, roofs, common landscaping, parking areas, and recreational facilities.
- Assessments & fees: Annual assessments start at a maximum of $300/unit; after the first year, they can increase up to 10% annually by board decision, or more with 66% member approval. Assessments fund common-area maintenance, landscaping, pool, insurance (minimum $500,000 liability), and reserves. Unpaid assessments accrue 8% annual interest and become a lien on your unit.
- Architectural review & changes: Any exterior or structural changes—including painting, fencing, alterations, or repainting—require written Association approval before work begins. The board may deny changes it deems unsuitable aesthetically or otherwise. You cannot exceed the original square footage of your unit. If the board doesn't respond within 30 days, approval is deemed granted.
- Leasing & rentals: You may lease your unit, but leases cannot be for transient stays (less than 30 days) or include customary hotel services (maid service, room service). All leases must comply with the community's covenants and restrictions.
- Use restrictions: Units are for single-family use only; no business, commercial, professional, or institutional use allowed. No temporary structures. Household pets are allowed (no breed/number limit stated). Storage, clotheslines, and garbage must be screened from neighbors' view. Landscaping and fencing require Association approval.
- Party walls between units: Shared walls between adjoining units are party walls. If you or your guests damage a party wall, you pay the full repair cost. If damage results from other causes (age, wear, deterioration), the Association pays. Disputes over repairs or cost-sharing are resolved through binding arbitration.
- Parking: Each unit receives one assigned covered parking space designated by the board. Additional uncovered spaces are reserved for two-car families and guests.
- Voting & membership: Unit ownership automatically grants Association membership and one vote per unit. Voting rights are suspended if you fall 15 or more days behind on assessments. The developer initially holds 7 votes per unit, converting to one vote per unit after 5 years or when other members' votes equal the developer's votes.
