Ashler Hills Estates is a single-family home HOA in Phoenix, AZ. These Covenants, Conditions & Restrictions (CC&Rs) apply to all owners and residents of lots 1–32 and the common areas. They establish the homeowners association, architectural control, and rules for the community.
- Property use & occupancy: All lots are for single-family residential use only (individual, family, or up to 3 unrelated persons). Home businesses are permitted only if not detectable from outside, no customer visits, and consistent with residential character.
- Leasing & rentals: Leases must be in writing, for the entire lot/residence, with a minimum term of 30 days. Owners must notify the board of any lease and provide tenant name, lease term, and owner's current address.
- Pets: Only generally recognized house or yard pets allowed, kept as domestic pets (not commercial). Reasonable number determined by board. Pets must be on a leash no longer than 6 feet when off the lot and must not create a nuisance. Owners must clean up droppings; structures for pets must not be visible from neighboring property.
- Parking & vehicles: No RVs, boats, trailers, or vehicles over 1 ton may be parked where visible from neighboring property, common areas, or streets (exceptions for pickups under 1 ton with camper shells under 7 ft). Non-operating vehicles must be in driveways only if repairs are imminent. Garage doors must be opened only for ingress/egress or use.
- Architectural & exterior changes: Any exterior alteration (color, additions, sheds, etc.) must be approved in writing by the Architectural Committee. Submit plans; if no decision within 60 days, deemed approved. The committee may charge a processing fee. Unapproved alterations may be removed at owner's expense.
- Assessments & fees: Annual assessments are set by the board and may increase up to 20% per year without member vote (exceeding 20% requires 67% vote). Special assessments require 2/3 vote. New owners pay a working capital fee equal to 1/6 of the current annual assessment and a transfer fee (amount set by board). Late fee: $15/month or 10% of delinquent amount (whichever greater). Assessments are a lien on the lot.
- Landscaping & desert preservation: Front yard landscaping must be completed within 90 days of closing; rear yard within 180 days. At least 40% of each lot (including entire front yard and part of rear yard) must be maintained as Desert Restoration Area with approved native plants. Accessory structures prohibited in Desert Restoration Area. All plantings over 36” in rear yards must conform to the approved plant list.
- Signs & other restrictions: Only one residential identification sign (≤80 sq in), one security sign (≤80 sq in), one for-sale/for-rent sign (≤5 sq ft), and signs required by legal proceedings are allowed without architectural approval. No outdoor burning of trash, no fuel tanks without approval, no reflective window treatments visible from street, and no basketball goals without prior committee approval (portable goals prohibited).
