Desert Forest South is a single-family residential subdivision in Cave Creek, AZ. These restrictions govern what homeowners can build and do on their lots. They aim to maintain the area as a 'choice and attractive residential district.'
- Use restrictions: Lots are for single-family dwellings only. No mobile homes or trailers are allowed. Professional offices, hospitals, and sanitariums are prohibited.
- Minimum dwelling size: Dwellings must have at least 1,490 square feet of floor area, excluding open porches, pergolas, and attached garages.
- Construction & materials: All construction must use new materials. Plumbing and wiring must be approved by the proper government agency. Exterior surfaces must be finished or made of natural finished material.
- Fences: Fences must be wood, chain link, block, or painted pipe rail (no other wire fences). All fences must be built with new materials. No solid wall, fence, or hedge over 4 feet high is allowed in front of the front wall of the house.
- Livestock: Lot owners may keep livestock as a hobby but not for material gain. Pigs, hogs, goats, and poultry are specifically prohibited. Livestock must be properly fenced per county regulations.
- Setbacks: The front wall of any dwelling must be at least 40 feet from the front property line, the rear wall at least 40 feet from the rear line, and side walls at least 30 feet from side property lines (or 30 feet if the side line is on a street).
- Prohibited uses: No noxious or offensive trade or activity. No dumping of rubbish or junk (except in an enclosed building). No use for residential purposes without water flush toilets inside the building and connection to septic tanks or sewers.
- Duration & amendment: These restrictions run with the land until February 1, 2001, then automatically extend for successive 10-year periods unless a majority of property owners vote to change them.
