What Avenida Siete Oeste's governing documents say
This document is a single-purpose amendment to the governing documents of the Avenida Siete Oeste Homeowners Association, a 50-unit townhome community in Phoenix, AZ. It replaces the previous rental rules with strict new limitations: generally, rentals are banned unless the Board grants a hardship exemption, and no more than a certain number of units may be rented under those exemptions. Existing owners as of the amendment's recording date are grandfathered — they can rent freely until they sell.
- Leasing & rentals: Owners cannot lease or rent their unit unless the Board first approves a written exemption for hardship or special circumstances. The Board may also deny any exemption if it would cause 24 or more units to be rented or leased (i.e., a maximum of 23 exemptions can be active at once). Timeshares and any transaction that effectively results in a rental are also prohibited.
- Grandfathering for current owners: All owners as of the recording date of this amendment are exempt from the rental restrictions until they sell their unit. A transfer to a living trust or similar estate-planning vehicle does not count as a sale. These grandfathered owners are not counted toward the 24-unit cap.
- Board’s authority: The Board may adopt rules and regulations to implement the rental restrictions, and has discretion over the duration of any hardship exemption (limited or indefinite).
- What this document doesn't cover: This is only a partial amendment about rentals. It does not cover any other rules such as pet limits, parking, architectural standards, or maintenance responsibilities. The full Declaration of Covenants, Conditions, and Restrictions (recorded in 1972) and other project documents would contain those rules.
